2. Scope
These terms govern access to the site, browsing product pages, using the configurator, creating an account, and sending requests through the Underside Apple Store.
3. Current nature of the flow
Unless Underside expressly confirms otherwise, adding products to the cart and sending a request through the store does not amount to automatic acceptance of an order. At this stage, the store is used to prepare a quote, a commercial validation step, or a later written confirmation from Underside.
4. Products, content, and displayed information
- Underside aims to present accurate and up-to-date information about products, options, visuals, pricing, lead times, and availability.
- Despite that care, the site may contain errors, omissions, delayed updates, or technical unavailability.
- Photos, illustrations, descriptions, translations, and technical information are provided for information purposes and may differ slightly from the final product or the manufacturer's configurator.
- Underside may correct any manifest error at any time, including pricing, description, compatibility, availability, or display errors.
5. Prices, changes, and availability
- Prices shown on the site are indicative and non-binding until Underside has confirmed the order or offer in writing.
- Prices may change at any time, including due to manufacturer or distributor changes, VAT changes, logistics costs, clerical mistakes, or manifest data-entry errors.
- Stock levels, lead times, and availability are provided on an indicative basis. A stock shortage, lead-time extension, or end-of-sale situation does not bind Underside before express written confirmation.
- If several pieces of information conflict, Underside's written confirmation prevails.
6. Orders, acceptance, and right to refuse
- Underside may refuse, suspend, or cancel any request or unconfirmed order, including in case of error, unavailability, suspected fraud, inconsistent information, or force majeure.
- A sale is deemed concluded only after express validation by Underside under the conditions communicated to the customer.
7. User accounts
Users remain responsible for the accuracy of the information they submit and for keeping their credentials confidential. Underside may restrict or deactivate an account in case of misuse, inaccurate data, or breach of these terms.
8. Limitation of liability
- To the extent permitted by applicable law, Underside shall not be liable for damage resulting from non-intentional site errors, price changes, unavailability, revised lead times, service interruptions, incompatibility, or information that became outdated before written confirmation.
- Underside is not liable for indirect, intangible, commercial, loss-of-margin, loss-of-business, loss-of-opportunity, or data-loss damages arising from use of the store.
- Nothing in these terms excludes or limits liability where such exclusion is prohibited by mandatory law, including in cases of fraud, wilful misconduct, gross negligence, personal injury, or mandatory consumer rights.
9. Warranties and statutory rights
If a sale is actually concluded with a consumer, the applicable mandatory statutory rights, including those relating to legal warranty and, where relevant, the right of withdrawal, remain fully applicable. These terms must be read subject to those rights.
10. Governing law and disputes
These terms are governed by Belgian law, subject to any mandatory protective rules that may apply to consumers. In the event of a dispute, the parties will first seek an amicable solution.
